Guest Wi‑Fi Terms of Service

By accessing or using the guest wireless internet service (“Wi‑Fi”) provided at Fourwinds Resort and Marina, operated by Traina Enterprises Inc. (“Company”), you agree to the following Terms of Service (“Terms”). If you do not agree, please do not use the Wi‑Fi service.

1. Service Description
The guest Wi‑Fi service (“Service”) is provided for the convenience of registered hotel and marina guests for lawful, personal, and non‑commercial use. The Service is offered on a best‑effort basis and may be limited, restricted, suspended, or terminated at any time without notice.

1.1 Internet Access & Bandwidth Tiers
All guest stays at Fourwinds Resort and Marina include standard internet access with bandwidth speeds of up to 10 Mbps per connection, provided as part of applicable miscellaneous or resort fees.

Guests may elect to purchase Business Class or Streaming Internet access, which increases the applicable bandwidth cap up to 30 Mbps per connection, subject to network availability.

All internet access, including upgraded service tiers, is provided on a best‑effort basis. Specific speeds, performance levels, or uninterrupted service are not guaranteed, and actual performance may vary based on network conditions, device capabilities, physical location on the property, and total number of connected users.

Fees associated with bandwidth upgrades will be disclosed at the time of purchase and are non‑refundable except where required by law. All other Terms of Service apply equally to standard and upgraded internet access.

2. Acceptable Use
You agree to use the Service only for lawful purposes. You may not use the Service to violate any local, state, federal, or international law; transmit unlawful, harmful, threatening, abusive, defamatory, or obscene content; engage in hacking, phishing, malware distribution, or denial‑of‑service attacks; infringe upon intellectual property rights; interfere with or disrupt the network; or conduct unauthorized commercial activity.

3. Prohibited Activities
The following activities are strictly prohibited:
• Attempting to bypass network security or authentication measures
• Accessing or attempting to access another user’s devices, accounts, or data
• Excessive bandwidth consumption that negatively impacts other guests
• Hosting servers, peer‑to‑peer file sharing, or torrenting services

4. No Expectation of Privacy
The Service is not encrypted or secure. You acknowledge that data transmitted over the network may be monitored, logged, intercepted, or disclosed as required by law. Traina Enterprises Inc. makes no guarantees regarding the privacy or security of communications. Guests are responsible for securing their own devices and personal data.

5. Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, either express or implied, including but not limited to availability, reliability, speed, security, or fitness for a particular purpose.

6. Limitation of Liability
To the maximum extent permitted by law, Traina Enterprises Inc. and Fourwinds Resort and Marina shall not be liable for any loss, damage, or injury arising from use of the Service, including but not limited to data loss, device compromise, security breaches, service interruptions, or consequential damages.

7. Indemnification
You agree to indemnify and hold harmless Traina Enterprises Inc., its officers, employees, and affiliates from any claims, liabilities, damages, or expenses arising out of your use or misuse of the Service.

8. Mandatory Arbitration and Waiver of Court Proceedings

Any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Service shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies. Arbitration shall be conducted on an individual basis and not as a class, collective, or representative action.

The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its applicable rules. The arbitration shall take place in the state where Fourwinds Resort and Marina is located, unless otherwise agreed by the parties. Judgment on the arbitration award may be entered in any court having jurisdiction.

By agreeing to these Terms, you knowingly waive the right to a trial by judge or jury and the right to participate in a class action lawsuit or class‑wide arbitration.

9. Termination of Access
Access to the Service may be suspended or terminated immediately, without notice, for violation of these Terms or for network management, security, or operational reasons.

10. Changes to Terms
These Terms may be updated at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state in which Fourwinds Resort and Marina is located, without regard to conflict‑of‑law principles, except that the Federal Arbitration Act shall govern the interpretation and enforcement of the arbitration provision.

12. Acceptance
By connecting to or using the guest Wi‑Fi network, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, including the mandatory arbitration provision.
